1. Definitions
1.1. “Visa+” Service (or the “Alias Directory Service”) – a service for “Visa” card users provided by the Institution, subject to these Terms and Conditions of “Visa+” Service (the “Terms”).
1.2. Identifier (or “Alias”) means an identifier used to identify you as a recipient, such as your telephone number and your first name and the first letter of your surname.
1.3. Institution (or we) is UAB Pervesk, registration number 304186270, address Gedimino pr. 5-3, LT-01103 Vilnius, Lithuania (e-mail info@pervesk.lt), acting as an electronic money institution licensed in the Republic of Lithuania (electronic money institution licence No 17; the licensing and supervising authority is the Bank of Lithuania, www.lb.lt; data on the Institution is collected and stored in the Register of Legal Entities of the Republic of Lithuania (the registry manager is the State Enterprise Centre of Registers). Due to provision of services under the General T&C and any Agreeemnt, accessible via the Website, Institution acts as a partner of Teroxx Worldwide, UAB (registration number 305956215, e-mail hello@teroxx.com) and uses the trademark “Teroxx”.
1.4. Participating Users – registered “Visa+” Service users whose financial service provider supports the “Visa+” Service functionality.
1.5. Preferred Card – the Card you select to be used by the “Visa+” Service for receiving funds. Any payment sent to your Identifier will be credited to the Account linked to your Preferred Card.
1.6. Other definitions used in these Terms have meanings as defined in the General T&C, the Law on Payments of the Republic of Lithuania, the Law on Electronic Money and Electronic Money Institutions of the Republic of Lithuania and other relevant legal acts.
2. Subject of Agreement and Scope of Application
2.1. The “Visa+” Service enables you to link your Card to your Identifier in the “Visa” Alias Directory, so that your Card details remain secure, private and you can receive funds from eligible “Visa+” Participating Users using your Identifier as the recipient identifier. Please pay attention that the “Visa+” Service provided by the Institution is limited to receiving funds only. The “Visa+” Service may be activated by following the activation procedure specified in these Terms.
2.2. The General T&C, Account Agreement, Payment Cards Agreement shall form an integral part of these Terms. Provisions of the General T&C, Account Agreement and (or) Payment Cards Agreement shall apply in cases both directly stipulated in the Terms (e. g. termination of the Agreement) or not directly stipulated (e. g. applicable law and disputes resolution) depending on the context. In the event of contradiction or discrepancy between these Terms and the General T&C, Account Agreement and (or) Payment Cards Agreement, terms and conditions of these Terms shall prevail, unless otherwise stated in these Terms.
3. Activation
3.1. The “Visa+” Service is available only for physical persons. You can use the “Visa+” Service provided by the Institution if the following conditions are met:
3.1.1. you have an eligible personal Account and an eligible Card;
3.1.2. you have chosen the Card settings option “Visa+”, agreed to these Terms, and proceeded to register a Preferred Card with the “Visa+” Service;
3.1.3. your Preferred Card and the Account linked to it are active, without any restrictions and used in accordance with the General T&C and its applicable Annexes.
3.2. The Institution reserves the right to reject any activation application without providing reasons, but we guarantee that such a refusal will always be based on valid reasons.
3.3. The same telephone number may be used as an Identifier across more than one participating financial service providers, however, only one card liked to that Identifier may be selected as the Preferred Card for receiving funds. Your Preferred Card may be a Card issued by the Institution or a card issued by another financial service provider, registered by you as preferred for the “Visa+” Service through that provider’s private channel. The Card registered by you for the “Visa+” Service shall be designated as the Preferred Card in accordance with your most recent registration. Accordingly, any funds received via the “Visa+” Service shall be credited to the Account linked to the Preferred Card most recently registered by you. Always make sure you have selected the desired card as your Preferred Card. You may update or deactivate your Preferred Card with the Institution at any time through the Internet Banking System.
4. Limitations
4.1. Amounts received via the “Visa+” Service may be subject to limits. Where such limits apply, the Institution shall have the right to unilaterally set and amend those limits for security reasons or other valid reasons.
4.2. Any payment received via the “Visa+” Service that violates any applicable law and (or) these Terms, or any terms of the services provided by us to you, is prohibited, and the Institution shall have the right to monitor, block, reject and (or) suspend such payment.
5. Liability
5.1. We shall not be liable for any damages, direct or indirect losses (including, but not limited to, loss of income) deemed or alleged to have resulted from or caused by, but not limited to the following scenarios or any of them:
5.1.1. incurred as a result of you designating the wrong Card as the Preferred Card;
5.1.2. incurred as a result of inaccurate information submitted by you in your User’s Account;
5.1.3. incurred as a result of the misuse and (or) inability to use the “Visa+” Service;
5.1.4. in case your Account has been closed and (or) seizes or your right to dispose the Account and (or) Card has been othervise restricted;
5.1.5. incurred as a result of any reason beyond the reasonable control of the Institution (including, but not limited to, any acts of law enforcement authorities or force majore).
5.2. By using the “Visa+” Service you also acknowledge and accept that the Institution makes no representation and (or) warranty that the “Visa+” Service will be uninterrupted, timely, secure or error-free, or that the “Visa+” Service will be available at all times, and the Institution shall not assume any liability in this regard.
6. Security
6.1. The Identifier is derived from the information provided in your User Account and is linked to your Preferred Card for the purposes of receiving funds. The sender may identify you and confirm the payment using your Identifier. You are responsible for ensuring that the information in your User Account is accurate and kept up to date, and you must promptly update it via the Internet Banking System in the event of any changes.
6.2. Your Identifier is created and managed in the User’s Account via Internet Banking System, which you access by using Identification Means. You shall not disclose or otherwise make Identification Means available to any third party and shall safeguard it in accordance with the General T&C. You are responsible for all actions performed using Identification Means where these have been disclosed by you.
6.3. In cases where you believe that your Identification Means, User Account and (or) Card have been lost, stolen or compromised, you must take all reasonable steps to disable their use and inform the Institution without undue delay, in the manner and within the time limits set out in the General T&C. Failure to do so may, depending on the reasons and circumstances of such inaction, result in your being required to assume an appropriate degree of liability as set out in the General T&C.
6.4. We shall have the right, at any time, to block or suspend your use of the “Visa+” Service if you breach these Terms or any other terms and conditions applicable to the services provided to you, or if such action is required by applicable law.
7. Commissions
7.1. We have the right to unilaterally apply and change Commissions for the provision of the “Visa+” Service. If such Commissions are applied, they shall be set out in the Standard Rates.
7.2. We shall not be responsible for any fees or charges imposed by third parties (such as telephone communication providers). You shall be solely responsible for any such fees or charges that may apply.
8. Personal Data
8.1. Our Privacy Policy (in particular its Annex 2 dedicated to the “Visa+” Service), which is published on the Website or in another way established by us, specifies how data is processed by both the Institution and Visa when “Visa+” Service is provided.
9. Termination
9.1. You may terminate the “Visa+” Service at any time by deactivating the selection of your Preferred Card with the Institution through your User Account via the Internet Banking System using the Card settings option “Visa+”.
9.2. The provision of the “Visa+” Service shall terminate automatically if your Payment Card Agreement for the Preferred Card has been terminated or the Account linked to the Preferred Card has been closed.
9.3. The provision of the “Visa+” Service also shall expire or may be terminated on the grounds and in accordance with procedure specified in the General T&C.
